The Preserve at Chapel Hill is a "single-family condominium" which is a unique type of development combining the best of two worlds: the seclusion and exclusivity of having your own private residence and the convenience of "no maintenance" condominium living.

    There are 21 condominium units within the 27-acre development located on the west side of Brookfield Road and north of Capitol Drive. Each condominium unit will consist of a parcel of land, and the space above and beneath the land, upon which a free-standing single-family home can be built. The condominium unit will be the parcel of land and not a structure or space within a structure as is the case with typical “condominiums.”

    The Preserve at Chapel Hill exemplifies thoughtful land use planning by preserving environmental areas and creating a refined sense of community. All of this is enhanced by the fact that every home in the community will be constructed by Chapel Hill Homes or Kings Way Homes, two of Wisconsin’s finest custom home builders. Strict architectural guidelines, emphasizing natural materials and harmonious architectural style will be adhered to in order to create a truly unique and exciting community.

    Natural Areas
    The Preserve at Chapel Hill was designed to maximize the preservation of the wetlands and wildlife habitat that surround the site. Careful consideration has been given to the delicate balance between development and conservation and how this community will operate in harmony with its natural surroundings. Certain areas of the development have been designated to remain in a “natural state” to provide habitat for threatened species, the Great Blue Heron Rookery, just west of the property, will continue to coexist alongside this quiet residential neighborhood. At the very south end of the property, an easement has been established in favor of the Waukesha County Parks Department for a future nature trail. Every effort has been made to create a development that exists in concert with, instead of in spite of, the natural areas surrounding it.

    The Condominium Declaration
    The Development will be established by the recording of a Declaration of Condominium and a Condominium Plat, as opposed to dividing the land into a single-family subdivision by virtue of a Subdivision Plat. The Condominium Declaration will establish the specific rights and obligations of each owner who purchases a Unit. It will also set forth the restrictions each owner has with respect to what they can do with their Unit.

    The Unit
    There will be 21 building sites (the “Building Sites”) within the community. Each Building Site resembles a single-family lot. Within each Building Site there will be a building pad area within which a freestanding single-family home may be constructed. The initial condominium unit (“Unit”) will consist of this entire building pad. Once a single-family home is constructed on a Unit, the Unit will consist of a pad of land that matches the boundaries of the foundation of the home. The Unit will extend 20 feet below the surface and 50 feet above the surface. Each homeowner will be allowed to construct one single-family home, including a patio or deck within this cubicle of space constituting a Unit, in accordance with strict Architectural Guidelines. The balance of the land within the owner’s Building Site will be Limited Common Area.

    • All building plans must be approved by the Architectural Control Committee.
    • One-Story Home: The minimum living area shall be not less than 2,100 total square feet. Roof pitch shall be not less than 10/12.
    • Two-Story Home: The minimum living area shall be not less than 2,500 total square feet. Roof pitch shall be not less than 8/12.
    • Garage: The minimum area shall be not less than 600 square feet.
    • Front exterior must have a sufficient amount of masonry (brick, natural stone, cultured brick, cultured stone, EIFS / Dryvit or stucco).
    • Siding materials (including exposed foundation walls) must be natural wood, fiber cement plank, brick, natural stone, cultured brick, cultured stone, EIFS / Dryvit or stucco.
    • All roofs shall have fully dimensional shingles with a minimum 30-year manufacturer’s warranty, in Weathered Wood color.
    • Setbacks will maintain a minimum distance of 40′ to the front lot line, 20′ to the side lot lines, 35′ to the rear lot line, and 40′ to any street right of way.
    • Uniform lamp post and mailboxes are required, and shall be purchased at the time of closing on the lot.
